NOV 01 '24 | 2024-023

Effective January 1, 2025, the Cboe Global Markets North American Data Policies (the “Data Policies”) will be amended as follows:

  • Eliminate the reporting requirement for external display of delayed, end-of-day, and historical Cboe Canada NEO order book data.
  • Require Controlled Data Distributors that distribute index Data to Data Users that have obtained an Enterprise license and/or Delayed Data User Fee Cap to report Data User quantities for each Data User every six months.
  • Amend the Derived Data API Service in relation to the requirement for an External Controlled Data Distributor to prohibit External Subscribers from distributing Derived Data to affiliates of the External Subscriber.
  • Expand the Display Usage fee exemption to Data Users for certain usage types across all Cboe Data products and asset classes.
  • Amend the policy regarding trial usage to, among other things, no longer require an External Controlled Data Distributor to enter into a trial addendum in order to provide Data on a Trial basis.

The above amendments are referred to herein collectively as the “Amendments”. This Notice is provided pursuant to Section 24 of the Cboe Global Markets Global Data Agreement (the “GDA”) to notify Data Recipients of the Amendments. Pursuant to the GDA, any receipt or use of Data by a Data Recipient after January 1, 2025, shall be deemed acceptance by the Data Recipient of the Amendments.
